JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 The petitioner seeks regular bail in connection with Beldour P.S. Case No. 67 of 2019, registered for offences punishable under Sections 307/34 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act. Allegation against the petitioner is of firing on the informant causing injury on his shoulder and after leaving the pistol, the petitioner fled away.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and although, there is allegation of firing on the petitioner, however, the injury sustained by the informant was found simple in nature. Further submission is that petitioner has no criminal antecedent and he has been in judicial custody since 26.09.2019.

Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate -1st Class, Khagaria, in connection with Beldour P.S. Case No. 67 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
