====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-09-2018 Heard learned counsels for the petitioners and learned A.P.P. for the State.

The petitioners being the brothers, brothers' wife and mother of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 498(A), 323, 504, 506 and 120(B) of the I.P.C. and under Section 4 of the Dowry Prohibition Act.

The basic accusation is of torture for non-fulfillment of further dowry demand of Rs. 2 lacs and Alto Car. It is submitted by the learned counsel for the petitioners that the marriage between the informant Jyoti Rani and Ashutosh Kumar was performed on 03.12.2016. Husband of the

Patna High Court Cr.Misc. No.57855 of 2018(2) dt.20-09-2018 2/2 informant, Aushtosh Kumar filed a Matrimonial Case No.515 of 2017 for declaring the marriage null and void and thereafter the present case has been lodged.

It is submitted by the learned APP that the accusation is specific against the petitioners.

Considering the facts that thrust of accusation is against the husband of the informant and the matrimonial case has been filed by the husband of the informant at earlier point of time, let the above named petitioners be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned S.D.J.M., Aurangabad in connection with Aurangabad Mahila P.S. Case No.21 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
