1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Tetarhaat Police Station Case No. 137 of 2025, disclosing offences under Sections 96 of the BNS, 2023.

3. As per the prosecution case, on 02.06.2025, the daughter of the informant had gone to the market but she did not return and upon search, the informant came to know that coaccused Sanoj Ravidas and petitioner enticed her daughter and kidnapped her for marriage.

4. Learned counsel for the petitioners submits that age of the victim girl is about 16 years and odd and co-accused

Patna High Court CR. MISC. No.89224 of 2025(2) dt.15-01-2026 2/3 Sanoj Ravidas is also young. Both were having adolescent love and have performed marriage. The statement of the victim girl has been recorded under Section 180 and 183 of the BNSS, 2023, in which she has not supported the prosecution story and has said that she was in love with co-accused Sanoj Ravidas and voluntarily went with her husband. Learned counsel further submits that the petitioners are mother and sister of Sanoj Ravidas and have falsely been implicated in this case merely because they happen to be the family members of the coaccused Sanoj Ravidas.

Having regard to the submissions made on behalf of the parties and taking into consideration the statement of the victim girl recorded under Section 183 of the BNSS, 2023, as mentioned in the impugned order and the fact that the petitioners are the family members of the co-accused Sanoj Ravidas, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount

No.89224 of 2025(2) dt.15-01-2026 3/3 each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Tetarhaat Police Station Case No. 137 of 2025, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
