JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-07-2020 Heard Mr. Pankaj Kumar, learned counsel for the petitioners and Ms. Anita Kumari, learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Muffasil (Samastipur) P.S. Case No. 220 of 2019, dated 13.05.2019, instituted for the offences

Patna High Court CR. MISC. No.87449 of 2019(4) dt.10-07-2020 2/3 under Sections 308, 323, 325, 341, 379, 447 and 504/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that the main allegation of assault on the informant is attributed to Yogendra Mahto.

There is a counter version of the occurrence as well in which, aforesaid Yogendra Mahto, who happens to be the father of the petitioners, has received grievous injury on his head. The other family members of the petitioners also have sustained injuries.

Regard being had to the general and omnibus nature of allegation against the petitioners, who have not been attributed with assaulting any person of the prosecution party, they, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 5th Addl. Chief Judicial Magistrate, Samastipur in connection with Muffasil (Samastipur) P.S. Case No. 220 of

Patna High Court CR. MISC. No.87449 of 2019(4) dt.10-07-2020 3/3 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
