JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 24-02-2020 Heard learned counsel for the petitioners, the informant and the learned A.P.P. for the State. The petitioners apprehend their arrest in connection with Shivsagar P.S. Case No. 236 of 2019 registered for the offences punishable under Sections 341, 323, 325, 307, 504 and 34 of the Indian Penal Code.

Prosecution case is that the informant Shanti Devi has given the fardbeyan to the police that on dated 30.06.2019 at about 4 P.M. when her son Manmohan Singh was busy in

The accused Chandan Kumar Singh came there and the verbal altercation has been started between accused Chandan Kumar and her son Manmohan regarding ploughing of the field. Accused Chandan Kumar was started abusing Manmohan Singh and assaulted on his head. When the informant came there to save her son, the accused also assaulted her and she also sustained injury on her head and her left arm was also fractured.

Learned counsel for the petitioners submits that the accused persons have been falsely implicated in this case and the entire allegations made by the informant are false and baseless. Learned counsel for the petitioners further submits there there is no evidence against the accused persons. He further submits the the land dispute between the parties is going on.

Learned counsel for the informant submits that there specific allegation against the petitioners. The statement of the informant had supported that the order of learned Additional Sessions Judge-VI shows that the injury of Manmohan Singh found is grievous.

In the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners.
