This application has been filed on behalf of the petitioners for modification in the order dated 26.02.2018 passed in Criminal Misc. No. 11145 of 2018, whereunder the petitioners and one Ritesh Das @ Ritesh Kumar Das have been granted pre-arrest bail.
Learned counsel appearing on behalf of the petitioners submits that, in fact, father's name of petitioner No.2 Subhash Das @ Subhash Kumar Das is Buddhu Das, as detailed in the F.I.R., but, inadvertently, the petition filed in Criminal Miscellaneous No. 11145 of 2018, the parentage of
Patna High Court Cr.Misc. No.58860 of 2018(2) dt.19-09-2018 2/2 petitioner No.2 Subhash Das @ Subhash Kumar Das was typed as Gorelal Das in place of Buddhu Das and due to the said typographical error petitioner No.2 could not furnish bail bond in the trial Court and petitioner No.1 also could not furnish bail bond.
In view of the submission of the learned counsel for the petitioners, in the order dated 26.02.2018 passed in Criminal Misc. No. 11145 of 2018, the father's name of the petitioner No.2 be read as "Buddhu Das", in place of Gorelal Das.
In such view of the matter, let the time to surrender of the petitioners as ordered in Cr. Misc. No. 11145 of 2018 on 26.02.2018 be further extended by four weeks from today in connection with Gogari P.S. Case No. 226 of 2015 pending in the court of Judicial Magistrate, 1st Class, Khagaria. With the aforesaid modification in the order dated 26.02.2018 passed in Criminal Misc. No. 11145 of 2018, this application stands disposed of.
