The petitioner apprehends his arrest in connection with Mojahidpur (Babarganj) P.S. Case No.27 of 2018, registered for the offences punishable under Sections 406, 420, 120(B) and 34 of the Indian Penal Code.

The accusation against the petitioner is of taking money in lieu of admission of complainant's son in a medical college. It is alleged that the son of the complainant was not admitted in the medical college and the petitioner did not return the money.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The petitioner has got one criminal antecedent as

Patna High Court CR. MISC. No.997 of 2020(14) dt.20-06-2023 2/2 stated in paragraph-3 of the bail petition. It is further submitted that the petitioner is ready to return Rs.4,00,000/- to the complainant within a period of four months.

Considering the offer made by the petitioner, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on provisional anticipatory bail for a period of four months on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Mojahidpur (Babarganj) P.S. Case No.27 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.

It goes without saying that the petitioner has to return Rs.4,00,000/- to the complainant within a period of four months. The learned court below shall confirm the bail bond of the petitioner after verifying the fact that the petitioner has already returned Rs.4,00,000/- to the complainant within a period of four months.
