None ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 20-09-2018 Heard Sri Krishna Kumar Singh, learned counsel for the petitioner. None appeared on behalf of the State. The sole petitioner, apprehending his arrest in connection with Revilganj P.S. Case No. 275 of 2017, registered for the offence under Section 420/467/ 468/471/34 of the Indian Penal Code 1860 , has prayed for grant of bail in the event of his arrest or surrender.
Learned counsel for the petitioner submits that F.I.R. was lodged on the basis of a complaint case i.e. Complaint Case No. 3044 of 2017 filed by one Smt. Sangeeta Kumari in which allegation was made that petitioner conniving with Mukhiya had illegally appointed one Kumari Latika by committing several acts of omission and commission. Learned counsel for the petitioner has drawn my attention to Annexure - 5 to the
Patna High Court Cr.Misc. No.58612 of 2018(2) dt.20-09-2018 2/2 petition i.e. an order dated 07.12.2017 passed in Appeal (Case ) No.: Token No. Appeal / 411 / 2017 passed by State Appellate Authority. He submits that State Appellate Authority has admitted the Appeal and directed for maintaining status quo. Considering the facts and circumstances, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner - Ram Nath Choudhary be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VIII, Chapra Saran / concerned court in connection with Revilganj P.S. Case No. 275 of 2017 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
