JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bypass P. S. Case No. 230 of 2018 registered for the offences punishable under Sections 323, 341, 382, 384, 387, 452 and 34 of the Indian Penal Code.

The accusation against the petitioners is that they having entered into the house of informant threatened him and took away ornaments and other belongings and also demanded rupees one lac in extortion.

Learned counsel for the petitioners submits that informant is a transgender and petitioners are Coolie at Patna City

Patna High Court Cr.Misc. No.60633 of 2018 (2) dt.06-10-2018 2/2 Railway Station and, as a matter of fact, petitioners opposed the vulgarity of the informant and his associates and that is why, the informant has brought this false case against the petitioners. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, above named, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Patna City, Patna in Bypass P. S. Case No. 230 of 2018 subject to conditions as laid down under Section 438(2) of the Cr. P. C.
