The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147/148/149/341/323/354A/448/380/307/504/506 of the Indian
Patna High Court Cr.Misc. No.60838 of 2018(3) dt.05-11-2018 2/3 Penal Code and Section 27 of the Arms Act.
Petitioner Md. Manobar @ Md. Mannobbar @ Md.
Manowar @ Manee and Md. Azad are alleged to have assaulted to the informant and her husband. The doctor has not found any injury on the vital part of the body of the two injured. Allegation against Md. Minhaz and several others is that they assaulted to Md. Sabbar. The doctor has found single and simple injury on the person of Md. Sabbar. Petitioner Nos.4 to 10 are not named in the FIR.
Learned counsel for the informant opposed the prayer on the ground that father of the informant had sustained fracture, a grievous injury. There is case and counter case. Considering the entire facts of the case, as discussed above, regarding allegation against the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Puraini Police Station Case No. 59 of 2018, subject to the conditions as laid down under Section 438(2) of
Patna High Court Cr.Misc. No.60838 of 2018(3) dt.05-11-2018 3/3 the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
