JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 Petitioner seeks regular bail in connection with Ramgarhwa P. S. Case No. 186 of 2019 registered for the offences punishable under Sections 341, 498A, 307, 504, 506, 34 of IPC and Section 3⁄4 of the Dowry Prohibition Act. As per prosecution case the petitioner happens to be the husband of the informant and there is allegation of assault and misbehaving against him and also there is allegation of attempt to kill her.

Submission of the learned counsel for the petitioner is that as a matter of fact, she has some illicit relation with some person, as such, she has filed a divorce case before the learned Principal Judge, Family Court, Motihari. There is no specific allegation as to what was demanded by the petitioner. No

Patna High Court CR. MISC. No.86483 of 2019(2) dt.14-01-2020 2/2 allegation as to when she was assaulted. No any injury report is brought on the record. Petitioner is in custody for about two and half months.

Heard learned A.P.P. as well as learned counsel for the informant who has appeared suo motu and submitted that she is still ready to live with the petitioner, but petitioner is not ready to keep her.

Having heard both sides, considering the submissions made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Raxual, East Champaran at Motihari, in connection with Ramgarhwa P. S. Case No. 186 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
