In this case, the petitioners are seeking anticipatory bail in connection with Complaint Case No.83 of 2018, registered for the offence punishable under Sections 167, 420, 466, 468, 471, 120 (B), 34 of the Indian Penal Code. Allegation has been made that the petitioners along with others in connivance with each other have committed forgery, tampered the Register II and created a new Jamabandi by misusing their official post, however, counsel for the
Patna High Court CR. MISC. No.85771 of 2019(2) dt.17-02-2020 2/2 petitioners submits that the allegation is completely not sustainable and even if some illegalities have been done, it can be rectified by the higher authority. It is urged that similarly situated co-accused, namely, Dharmendra Pandit has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 22.01.2020 passed in Cr. Misc. No.86175 of 2019.
Looking to the entire facts and circumstances of the case, let the petitioners, above-named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Complaint Case No. 83 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
