The petitioner seeks bail in a case registered for the offences punishable under Sections 387, 34, 447 of the Indian Penal Code and Sections 25(1-b)a/26, 27 of the Arms Act. Prosecution case as lodged by the informant is that on that day when he was boring on his land then all three FIR named accused persons came there and demanded Rangdari of Rs. 50,000/- from him upon his denial Laxman Yadav told if you want to remain alive then you have to pay Rangadari otherwise you will be killed and took out a country made firearm from his waist and fired upon him but he any how saved himself and snatched and said firearm from him and later on deposited the same at police station and prayed for appropriate

Patna High Court CR. MISC. No. 85190 of 2019(3) dt.18-03-2020 2/2 legal action against the accused persons.

Learned counsel for the petitioner submits that petitioner is innocent. He submits that there is land dipsute between the parties. He submits that earlier uncle of informant filed a complaint petition against the father, brother and others vide complaint case No. 739C/2003 for the offence under Section 147, 148, 149, 323, 342, 379, 384 of the Indian Penal Code and Section 27 of the Arms Act. He submits that sizure list witnesses is bother and another seizure list witness is cousin of the informant. He further submits that petitioner is in custody since 27.09.2019.

In the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Khagaria in connection with Alauli P.S. Case No. 311 of 2019 (G.R. No. 2711 of 2019).
