The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379 and 414 of the IPC.

The prosecution case is that during vehicle check, the informant being police officer, intercepted three persons riding on a motorcycle. The said motorcycle was suspected to be stolen one. After seeing the police, all the three accused persons started fleeing away and on chase, two co-persons were apprehended who disclosed the name of third person as Rahul Kumar (son of Mohan Singh), the petitioner.

It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner. He has only been roped in the present case on the ground that he has been named by the

Learned APP submits that there is specific accusation against the petitioner.

Considering the fact that no recovery has been made from the petitioner, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-XIV, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 130 of 2018 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
