The petitioner seeks bail in anticipation of his arrest in connection with Ekma P.S. Case No. 185/2019 dated 10.08.2019 instituted for the offences under Sections 420, 467, 468/34 of the Indian Penal Code.

It has been alleged by the informant that the petitioner, in connivance with the bank authorities has withdrawn Rs. 40,000/- from her bank account.

No.86679 of 2019(3) dt.22-06-2020 2/3 Learned counsel for the petitioner has drawn the attention of the Court to the statement of the informant wherein she has spoken in detail about various dates on which certain amount of money has been withdrawn. If those amounts are added up, it comes to only Rs. 24,200/- but she has alleged that from her account, Rs. 40,000/- has been withdrawn. There is no further detail provided by the informant as to whether the amount was withdrawn by cash or it was diverted in another account.

The petitioner also has applied before the bank for the details of such withdrawal which has been saddled upon him. Till date, it has been submitted, no report has been given by the bank.

For the paucity of specific details for the prosecution case to stand, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the

However, the petitioner shall participate in the investigation and any refusal of the petitioner to co-operate in the investigation shall render the anticipatory bail of the petitioner liable to be cancelled.
