Petitioner seeks bail in Trial No.64 of 2018 arising out of Piar P.S. Case No.63 of 2018 instituted for the offence under Section(s) 376 Indian Penal Code and Section 4/6 of the POCSO Act.
It is alleged in the written report that petitioner took four years old daughter of the informant on the pretext of giving her biscuit and committed illegal act with her. Blood was coming out from her private part.
Counsel for petitioner submits that victim girl has been examined medically on the same day. Medical report of the victim is annexed as Annexure-2, wherein, doctor has found no
Patna High Court Cr.Misc. No.63200 of 2018 (2) dt.12-10-2018 2/2 injury, no swelling and no bleeding. Hymen was found intact. Counsel for the petitioner further submits that mere suspicion has been raised against the petitioner.
Petitioner is in custody since 12.05.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, POCSO Act, Muzaffarpur, in connection with Trial No.64 of 2018 arising out of Piar P.S. Case No.63 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) JA/- U T
