JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2019 This is an application for grant of anticipatory bail in connection with Bathnaha P.S. Case No. 159 of 2019, disclosing offences under Sections 272, 273/34, 414 of the Indian Penal Code and Sections 30(a) & (c) of the Bihar Prohibition and Excise Act, 2016.

As per prosecution case, on information of carrying of liquor by four wheeler vehicle, the police intercepted the vehicle, two persons succeeded in fleeing away and two persons were arrested at the spot and altogether 74.535 liters of foreign liquor was recovered. F.I.R. also disclosed that the arrested persons named this petitioner and one person, who succeeded in fleeing away. Apart from that petitioner is accused in one more case of similar nature.

No.84413 of 2019(2) dt.19-12-2019 2/2 Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against him and earlier case also on confessional statement of the coaccused, he has made accused. Heard learned A.P.P. also.

Having heard both sides, in view of the allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, which shall be considered by the learned trial court on its own merit, without being prejudiced by order of this Court and if, possible to be disposed of on the same day.
