JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-10-2018 The petitioner seeks regular bail in connection with N.D.P.S. Case No. 19/2018 arising out of Madhuban P.S. Case No. 54 of 2018, registered for offences punishable under Sections 414 of Indian Penal Code Section 25(1-B)a, 26(ii) and 35 of the Arms Act and Section 20, 22 of the N.D.P.S. Act. Allegation against the petitioner is of recovery of 250 grams of Charas.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. Moreover, the recovery is only 250 grams of Charas, which is less than the commercial quantity. Further he has been in judicial custody since 31.03.2018. Heard learned A.P.P. also.

Having heard both sides, considering the fact and

Patna High Court Cr.Misc. No.60918 of 2018 (2) dt.10-10-2018 circumstances of the case and also the criminal antecedents of the petitioner, I am not inclined to enlarge the petitioner on bail. However, the petitioner is at liberty to renew his prayer for bail after six months.
