Petitioner apprehends his arrest in a case registered under Sections 272, 273, 120(B)/34 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act. 2016. Informant who is the police officer has alleged in his self statement that on 17.07.2019 he received information that on the bank of river Charaki illicit liquor is being manufactured and upon receiving said information he raided the place and on seeing police six miscreants fled away and villagers disclosed the name of petitioner as one of the persons who fled away and 10 litres of Mahua wine was recovered from said place. It has been submitted on behalf of petitioner that petitioner has no criminal antecedent and he has been falsely

Patna High Court CR. MISC. No.84492 of 2019(2) dt.19-12-2019 2/2 implicated in this case on account of village rivalry and animosity. Nothing has been recovered from his conscious possession or from his house nor he has been apprehended on the spot.

Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Chandi P.S. Case No. 131 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
