Petitioner seeks bail in Begusarai Nagar P.S. Case No.94 of 2018 registered under Section 302 of the IPC and under Section 27 of the Arms Act.
The informant alleged that while her husband was returning after duty was shot dead by some miscreants near jail gate on NH 31. The police informed the informant and she came to hospital where she found her husband dead. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. No incriminating material has been collected. No T.I.P. was held. During course of investigation the petitioner was arrested and his confessional statement was recorded. Save and except the so-called confessional statement, there is no material against the
Patna High Court CR. MISC. No.3283 of 2020(5) dt.05-06-2020 2/2 petitioner. Similarly situated co-accused persons have already been granted bail vide Cr.Misc.No.32326 of 2018, Cr.Misc.No.32535 of 2018, Cr.Misc.No.33458 of 2018 and many others.
Having considered the facts aforesaid, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of Court of F.T.C.
