JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-02-2020 This application has been filed for cancellation of the anticipatory bail granted to the O.P.no.2 vide order dated 7.11.2019 by the Ist Addl. Sessions Judge, Muzaffarpur in ABP No.3151 of 2019 arising out of Complaint Case No.1845 of 2019 under Section 498(A) of the IPC.

Grounds for cancellation of the bail is that only because O.P.no.2 is aged about 82 years, he has been granted anticipatory bail whereas the petitioner is also aged about 70 years and she has been thrown outside and not providing any amenities and facilities as such she has come come for

Heard learned APP and perused the impugned, from which it appeaser that the petitioner is aged about 82 years and he has retired as the Principal of a Government Engineering College and considering the same, the learned court below has granted anticipatory bail to him. There is no allegation of misuse of the privilege of the bail or tampering with the evidence. In view of the discussions made above I am not inclined to interfere with the order granting anticipatory bail to the O.P.no.2. According, this application is dismissed.
