Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498(A)/34 of the Indian Penal Code and

Patna High Court CR. MISC. No.646 of 2020(6) dt.20-12-2021 2/3 Section 3/4 of the Dowry Prohibition Act.

The basic accusation is of torture for nonfulfillment of dowry demand and ousting the daughter of the complainant from her matrimonial house.

The petitioner is husband of the daughter of the complainant.

It is submitted by learned counsel for the petitioner that daughter of the complainant has deserted the petitioner since 2014.

A supplementary affidavit has been filed on behalf of the petitioner wherein it has been stated that daughter of the complainant has performed second marriage with one Mahanand Mandal son of Wakil Mandal, resident of Village-Kanhaiya Chak, P.S.- Parwata, District-Khagaria and she is presently residing with her present husband Mahanand Mandal in the village Kanhaiya Chak.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or

No.646 of 2020(6) dt.20-12-2021 3/3 surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Khagaria in connection with Complaint Case No. 1157C of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
