JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-12-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Parsa P.S. Case No. 126 of 2018 for the offence under Section 409 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that at the relevant time, the petitioner was working as headmaster and Rs.18,99,225/- was sanctioned for construction of building of the School. He submits that construction of the building of the school was not completed, therefore, the petitioner deposited Rs.17,42,000/- and remaining Rs.1,57,225/- is lying in the account maintained for the purpose of construction of building under Sarva Shiksha Abhiyan.

Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below

Patna High Court Cr.Misc. No.62528 of 2018(3) dt.12-12-2018 2/2 within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XIII, Saran at Chapra in connection with Parsa P.S. Case No. 126 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

The Court below is directed to verify the fact that Rs.17,42,000/- was deposited by the petitioner and remaining amount of Rs.1,57,225/- is lying in the account maintained for the purpose of construction of building under Sarva Shiksha Abhiyan.
