The petitioner seeks bail in Buniyadganj P.S. Case No. 8 of 2015 instituted for the offence under Sections 302 and 120(B)/34 of the Indian Penal Code.

It is alleged in the written report that on 8.1.2015 while the informant and her family members were sleeping after taking meal, six persons including petitioner at about 12:30 hours in the night entered into her house and took away her husband from the room and started cutting neck of her husband. The informant raised alarm, then younger brother of husband of the informant came. It is further alleged that accused persons tied the legs and hands of younger brother of husband of the informant. Patna High Court Cr.Misc. No.61834 of 2018(3) dt.19-11-2018 2/3 Kumar Singh, Vikram Singh and petitioner in course of cutting neck of her husband and he died on the spot. It is further alleged that on 29.12.2014 the petitioner along with others had come and sold the paddy, on account of which altercation took place between husband of the informant and others. Counsel for the petitioner submits that petitioner is student. He has clean antecedent. He is distant relation of the informant. He has no concern with family members of the informant.

In the written report there is specific allegation against co-accused Ram Kumar Singh that he cut the neck of the husband of the informant with Fasuli. As per written report the allegation against the petitioner is that he along with coaccused Vikram caught hold the hands and legs of husband of the informant.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Buniyadganj P.S.
