The petitioner seeks bail in connection with Excise Case No. 922 of 2018 arising out of Sahebpur Kamal P.S.Case No. 101 of 2018 registered under Sections 414, 420, 467, 468 and 120B/34 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged that in total 3326.4 litres of illicit foreign liquor as well as 882 litres of illicit foreign liquor of Punjab made was recovered from a truck which was being driven by this petitioner. The aforesaid liquor has been kept concealed in the bags of potato. In this manner, it appears that petitioner was engaged in smuggling of illicit foreign liquor, which is banned in the State, therefore, the Court is not inclined to grant

Patna High Court Cr.Misc. No.64233 of 2018(2) dt.26-10-2018 2/2 privilege of bail to the petitioner. Accordingly, the prayer for bail of this petitioner is rejected.

Petitioner is granted liberty to renew prayer for bail after six months, if no substantial progress is made in trial. (Sanjay Priya, J) sujit/- U T
