The petitioner seeks bail in a case registered for offences punishable under Section 392 of the IPC. Initially, the case was registered under Section 392 of the Indian Penal Code but it is contended that charge-sheet has been submitted under Section 395 of the Indian Penal Code. It is further contended that the petitioner is not named in the first information report and he has been implicated in this case on the basis of confessional statement of one Mantu Kumar Yadav, who has already been granted bail by a co-ordinate Bench of this Court vide Annexure 2. It is further stated that there is no recovery from the possession of the petitioner and he has not

Patna High Court Cr.Misc. No.62746 of 2018(2) dt.08-10-2018 2/2 been put to any Test Identification Parade and that apart, he is in custody since 03.08.2018 having clean antecedent. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Saharsa in connection with Mahishi P.S. Case No. 48 of 2017.
