Petitioner, who is in custody, seeks bail in connection with Industrial P.S. Case No. 96 of 2018 registered for the offences punishable under Sections 75/82 of Juvenile Justice Act.
Allegation against the petitioner is of harassment and cruelty upon the children when he was posted as the Superintendent of Children Home, Bhagalpur run by Rupam Pragati Samaj Samittee.
It has been submitted on behalf of the petitioner that petitioner is innocent and has committed no offence but due to part of management of 'Rupam Pragati Samaj Samittee' the petitioner has also been made accused in this case without any
Patna High Court Cr.Misc. No.64002 of 2018(2) dt.02-11-2018 2/2 valid and cogent evidence. Petitioner was not posted under the above society at the time of conducting of Social Audit report and the Social Audit report has not mentioned name of the petitioner which shows the innocent of the petitioner. It has been further alleged that petitioner reported the matter to the higher officials against the irregularities committed in the children home and due to that reason the petitioner was removed from the post of Superintendent in the year 2017. Petitioner is in custody since 06.08.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,-IXth, Bhagalpur, in connection with Industrial P.S. Case No. 96 of 2018.
