This application is for grant of regular bail in connection with S.Tr. NO.267 of 2018 arising out of Samastipur (Town) P.S.Case NO.04 of 2018 dated 4.1.2018 for the offences under Sections 395/412 of the Indian Penal Code. Allegation against the petitioner as per FIR is of dacoity committed in the UCO Bank.
Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and except confessional statement there is nothing against him and though cash has been recovered from his possession which he had kept for construction of his house by selling the land and he is in custody since 25.1.2018.
Heard learned A.P.P. also, who has cited several
Patna High Court Cr.Misc. No.62777 of 2018 (3) dt.06-11-2018 2/2 paragraphs of the case diary and there is recovery of Rs.05 lac and odd from his house, which he has stated that it has come in his share and further submission is that the petitioner has criminal antecedent also . He is accused in three other cases also, which appears from Para no.618 of the case diary.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial.
With the aforesaid observation, this application is dismissed.
