====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-01-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Goreya Kothi P.S. Case No.128 of 2019 registered under Section 396 of the Indian Penal Code besides Section 27 of the Arms Act. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner is not named in the F.I.R. as on the basis of the fardbeyan of the informant, the present case was instituted against 5 unknown. In course of investigation, one Sabindra Mahto was apprehended by the police, who disclosed the name of 16 persons including the petitioner having hand in the present case. In fact, the petitioner was apprehended by the police in Siwan

Patna High Court CR. MISC. No.87203 of 2019(2) dt.20-01-2020 2/2 Town P.S. Case No.436 of 2019 instituted under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-B)a of the Arms Act. Thereafter, the police implicated the petitioner in six other cases, as detailed in paragraph-3 to this application, and also in the present case, showing his name in the confessional statement of the co-accused Sabindra Mahto. The petitioner, in the present case, is in custody since 05.08.2019 and, on investigation, the police has already submitted the charge-sheet against the petitioner in the present case.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, DistrictSiwan, in connection with Goreya Kothi P.S. Case No.128 of 2019. Out of the two sureties, one must be close relative of the petitioner.
