Petitioner seeks bail in a case registered for the offence punishable under Sections 20, 22 of NDPS Act and Sections 25(1-b)a, 26 and 35 of the Arms Act. Allegation against the petitioner is recovery of 1 kg. 10 gms. Charas from his possession which is of commercial quantity.

It has been submitted on behalf of the petitioner that petitioner is in custody since 27.09.2017 and till date charges have not been framed.

Considering the facts and circumstances of the case and nature of allegation, I am not inclined to grant bail to the petitioner. Hence, the prayer for bail of the petitioner is hereby

Patna High Court CR. MISC. No.86952 of 2019(2) dt.18-01-2020 2/2 rejected.

However, the Special Court is directed to expedite and conclude the trial within one year from the date of receipt/production of the copy of the order. If the trial is not concluded within the aforesaid period of one year, petitioner may renew his prayer for regular bail.
