JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2018 The petitioner seeks regular bail in connection with Sono P.S. Case No. 120 of 2018, registered for offences punishable under Sections 147, 148, 149, 307, 302 and 120(B) of the Indian Penal Code.
Allegation as per F.I.R. is of assault to the deceased by Mohan Yadav and there is allegation of assault against the petitioner and other co-accused persons to one Raju Yadav. Submission of learned counsel for the petitioner is that allegation of assault to the deceased is not against the petitioner, rather the allegation of assault against the petitioner is to one Raju Yadav, but Raju Yadav has not received any injury and the petitioner is in judicial custody since 09.05.2018. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts,
Patna High Court Cr.Misc. No.67131 of 2018(2) dt.27-11-2018 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Jamui, in connection with Sono P.S. Case No. 120 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
