The petitioner seeks regular bail in connection with Excise Cae No.1346 of 2019 dated 16.11.2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of 237 ltrs. of liquor from the house of the brother of the petitioner and the petitioner is also made accused in this case. Apart from that he is accused in one more case of the excise act. Submission of the learned counsel for the petitioner is that he is in custody for one month and moreover recovery is not from is house rather from the house of his brother, who has been granted privilege of bail by a Co-ordinate Bench of this

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge VII cum Special Judge Excise Act, Aurangabad in connection with Excise Case No.1346 of 2019 dated 16.11.2019. With the aforesaid observation, this application is allowed.
