JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioners seek regular bail in connection with Kusheshwar Asthan P.S. Case No. 170 of 2019, registered for offences punishable under Section 341, 342, 323, 302 and 34 of the Indian Penal Code.

Allegation is of committing murder of the brother of the informant.

It has been submitted on behalf of the petitioners that they are not named in the F.I.R. , later on their names transpired in this case and they have been made accused in this case only because the co-accused persons of this case against whom there is allegation of committing murder of brother of informant were arrested from the house of the petitioners and one country made

Patna High Court CR. MISC. No.2818 of 2020(4) dt.27-02-2020 2/2 pistol was recovered from the petitioners and except that there is nothing against the petitioners and they have been in custody since 01.10.2019.

Having heard both sides, in view of the above submissions, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Biraul, Darbhanga, in connection with Kusheshwar Asthan P.S. Case No. 170 of 2019, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
