Petitioner, who is in custody, seeks bail in connection with Kesariya P.S. Case No. 132 of 2018 registered for the offences punishable under Section 392 of the Indian Penal Code.

Informant has alleged that on the day of occurrence he was coming to Customers Service Center after collecting Rs. 50,000/- and same was looted by four unknown miscreants riding on two motorcycles on the strength of revolver and knife. It has been submitted on behalf of the petitioner that he has been falsely implicated in this case only on the basis of confession made by co-accused Dinanath Sahani and except said confession no incriminating material is against the

Patna High Court Cr.Misc. No.67568 of 2018(2) dt.27-11-2018 2/2 petitioner. Nothing has been recovered from the possession of the petitioner nor he has been put on Test Identification Parade. He is in custody since 09.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Kesariya P.S.
