JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 The petitioner seeks regular bail in connection with Pirbahor P.S. Case No. 162 of 2019, registered for offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act. Prosecution case is that police on information raided the house of one Md. Rajan @ Md. Parwej and recovery arms and ammunition and the said accused person disclosed the name of petitioner.

It has been submitted on behalf of the petitioner that although, petitioner is accused in several other cases but in this case save and except confessional statement of co-accused, there is absolutely nothing against the petitioner and he has been roped in the present case at the instance of police. Further submission is that there is no recovery either from the possession of the petitioner or from his house and he has been in

Patna High Court CR. MISC. No.1626 of 2020(2) dt.14-01-2020 2/2 judicial custody for nine months.

Having heard both sides, in view of the submission as above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge -IV-cum-ACJM, Patna, in connection with Pirbahor P.S. Case No. 162 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
