JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 323, 402, 379/34 of the Indian Penal Code.
According to the complaint case itself, the co-accused Ram Sewak Mahto took the cash from the complainant in the name of providing job so far as petitioners are concerned, they are son and wife of the aforesaid co-accused Ram Sewak Mahto. Moreover, the alleged delivery of cash was made in the year 2004 and the present case was lodged in the year 2016 that
Patna High Court Cr.Misc. No.68473 of 2018(2) dt.17-12-2018 2/2 is after 12 years of the alleged occurrence.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Begusarai in Complaint Case No. 1625 of 2016 subject to condition as laid down under Section 438(2) of the Cr.P.C.
