The petitioner seeks regular bail in connection with Chandi PS case no. 136 of 2019 instituted for the offence punishable under Sections 272, 273, 120B/34 of Indian Penal Code and Section 30(a) Bihar Prohibition and Excise Act. The allegation is regarding recovery of 200 liters of illicit liquor from the co-accused person namely Nandji Yadav and upon interrogation by the police, it has transpired that the petitioner is also one of his accomplice. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, is having a clean antecedent and is languishing in custody since 20.09.2019.

No.86590 of 2019(3) dt.16-01-2020 2/2 Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that the petitioner is having a clean antecedent and no recovery of illicit liquor has been made from the possession of the petitioner, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-IVth-cum-Special Judge, Excise, Bhojpur, Ara in connection with Chandi PS case no. 136 of 2019.
