2. Petitioner seeks bail, who is in custody since 26.11.2024, in connection with Sessions Trial No. 59 of 2024 arising out of Motipur P.S. Case No. 223 of 2023, F.I.R. dated 14.07.2023 registered for the offences punishable under Sections 341, 323, 302, 504, 34 of the Indian Penal Code.

3. Learned Senior counsel for the petitioner submits that earlier the bail petition of the petitioner was rejected vide order dated 24.06.2025 passed in Cr. Misc. No. 37404 of 2025. He further submits that the petitioner is in custody since 26.11.2024 and the trial is not in progress.

Learned APP for the State, on the other hand, vehemently opposed the prayer for bail of the petitioner and submits that from perusal of the F.I.R. it appears that there is direct and specific allegation against the petitioner that he has assaulted the deceased by means of iron rod on his head and the direct and specific allegation against the petitioner supported by the medical evidence (postmortem report).

5. Considering the nature of allegation as alleged in the F.I.R., I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 59 of 2024 arising out of Motipur P.S. Case No. 223 of 2023 pending in the Court of learned Additional Sessions Judge, Muzaffarpur.

6. Prayer is refused.
