JUSTICE SUDHIR SINGH ORAL ORDER 25-01-2022 Due to the third wave of COVID-19 Pandemic, the matter is being taken up by way of Virtual Court proceeding. The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard the parties through virtual mode.

On behalf of the petitioner, it has been submitted and further it is evident from the counter affidavit filed on behalf of the State that the process under Sections 82 and 83 of Cr.P.C. has already been issued against the petitioner. In the said circumstances, the present anticipatory bail of the petitioner is not maintainable.

Hence, counsel for the petitioner seeks permission to withdraw the present application with a liberty to make prayer for regular bail before the court below.

The present application for anticipatory bail stands dismissed as withdrawn, in connection with Maharajganj P.S. case No.190/2019 pending in the court of A.C.J.M. V, Siwan. If the petitioner surrenders before the court below and prays for regular bail, same shall be considered on its own merit without being prejudiced by this order.
