The petitioner seeks bail in Giriyak (Katari Sarai) P.S. Case No. 357 of 2018 registered under Sections 30, 38 and 41 of Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. Petitioner and other accused persons are named in the F.I.R. and they are alleged to have fled away from the place of occurrence from where 1,215 liters of liquor was recovered. It is submitted that similarly situated other accused persons namely Sandeep Kumar and Pramod Mahto have already been granted bail.

Considering the aforesaid facts and nature of allegation made against the petitioner and the fact that similarly

No.73665 of 2018(2) dt.12-12-2018 2/2 situated accused persons have been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.5,000/-(Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional District and Sessions Judge-cum-Special Judge, Excise, Nalanda, Biharsharif in connection with Giriyak (Katari Sarai) P.S. Case No. 357 of 2018.
