The petitioner seeks regular bail in connection with Dumariyaghat P.S. Case No. 47 of 2018 registered for the offence punishable under Sections 387, 384 and 386/34 of the Indian Penal Code.

The allegation is regarding the co-accused person namely Shashi Kumar Singh having gone to the informant's place and made him talk to the petitioner herein on mobile whereupon a demand of ransom was made, however, subsequently the informant succeeded in apprehending the said co-accused person with the help of the villagers and he disclosed about the complicity of the petitioner herein. The learned counsel for the petitioner submits that neither the mobile has been found to be in the name of the petitioner nor the location of the calls made therefrom has been found to be nearby the jail in which the petitioner has been

Patna High Court Cr.Misc. No.70846 of 2018(3) dt.10-01-2019 2/2 lodged, hence the complicity of the petitioner is not present in the present case and he has got nothing to do with the alleged crime. However, considering the criminal antecedent of the petitioner herein, the learned counsel submits that the petitioner is ready for imposition of such conditions as may be deem fit and proper by this Court for the purpose of grant of regular bail. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Dumariyaghat P.S. Case No. 47 of 2018.

It is further directed that the petitioner would mark his attendance before the Officer In-Charge of the concerned Police Station at 10:30 A.M. on each and every Monday of the week and on his failure on two consecutive occasions to mark his attendance, the present privilege of regular bail shall stand cancelled automatically and the petitioner shall be taken into custody.
