JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2018 The petitioner seeks regular bail in connection with Baikunthpur P.S. Case No. 141 of 2018, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation as per F.I.R. is that police recovered 17 and odd litres of liquor from the co-accused of this case, who disclosed the name of petitioner and one other persons as the person, who gave them the said liquor. For verification police reached at the place disclosed by the co-accused persons and recovered 375 litres of illegal wine.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case only on the disclosure made by the co-accused of this case. Further he has

No.71626 of 2018(2) dt.10-12-2018 2/2 no criminal antecedent and has been in judicial custody since 23.09.2018 and the co-accused on whose disclosure, the name of petitioner surfaced in this case has already been enlarged by a coordinate Bench of this Court vide order dated 17.7.2018 passed in Cr. Misc. No. 42854 of 2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of 2nd Addl. Sessions Judge-cum- Special Judge, Excise Act, Gopalganj, in connection with Baikunthpur P.S. Case No. 141 of 2018.
