Petitioner is apprehending his arrest in connection with Azam Nagar P.S.Case No.223 of 2019 , registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
One Accused was arrested from the the train and another accused succeeded in fleeing away. There is recovery of 05 ltrs. of liquor from the co-accused and the name of the petitioner transpired on the disclosure made by the co-accused and on the basis of that he is also named in the FIR. Submission of the learned counsel for the petitioner is that except the confessional statement, there is nothing against him and he has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the2019 like amount each to the satisfaction of the learned Addl. Sessions Judge 2 cum Special Judge, Excise Act, in connection with Azam Nagar P.S.Case No.223 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
