1. Heard learned counsel for the petitioner and the learned APP for the State.

2. The Court is taking a consistent view of not extending the time of surrender if the petitioner has not surrendered within the time stipulated in the order by which the petitioner was granted the privilege of anticipatory bail, but then the instant case is an exception.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner was granted the privilege of anticipatory bail by order dated 03.11.2025 in Criminal

Patna High Court CR. MISC. No.11884 of 2026(3) dt.24-07-2026 2/3 Miscellaneous No. 51162 of 2025 passed by the then learned Co-ordinate Bench with a direction to the petitioner to surrender within a period of six weeks from the date of order.

4. It is submitted that the petitioner could not surrender within the time stipulated in the order dated 03.11.2025 in Criminal Miscellaneous No. 51162 of 2025 passed by the then learned Co-ordinate Bench. It is submitted that petitioner is suffering from cancer, as would manifest from Annexure- P/2 series to the modification application i.e. Discharge Summary of the petitioner from Deenanath Mangeshkar Hospital & Research Center, Pune. It is next submitted that since petitioner was suffering from cancer and had to be operated and was on chemotherapy, but then after operation again cancer resurfaced, hence, the petitioner could not surrender in time. It is further submitted that petitioner presently is under treatment at Pune.

5. The learned APP for the State also does not oppose the modification application of the petitioner.

6. After hearing the learned counsel for the parties, Para 6 of the order dated 03.11.2025 in Criminal Miscellaneous No. 51162 is modified to the extent that if petitioner surrenders within a period of eight weeks from today,

7. The other conditions shall remain the same.

8. The order dated 03.11.2025 in Criminal Miscellaneous No. 51162 is modified to the extent indicated above.
