2. The petitioner is apprehending his arrest in connection with Bypass P.S. Case No. 593 of 2025 registered for the offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act.

3. As per the allegation in the FIR, total 43 litres of country made liquor from sacks has been recovered from the possession of accused persons including present petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that name of the petitioner has been transpired with oblique purpose and ulterior motive. He further submits that petitioner has no concern with the alleged recovered liquor and

He next submits that there is no legal evidence or cogent material available to connect the petitioner with the alleged offence in question. He next submits that petitioner has got two criminal antecedents as stated in para-3 of the bail petition.

5. However, learned APP for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submission of learned counsel for the petitioner, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the court below within a period of six weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court of excise, Patna City, District-Patna in connection with Bypass Excise P.S. Case No.593 of 2025 subject to the condition as laid down under Section 482 of BNSS and also with a further condition that the petitioner shall reside within the jurisdiction of the concerned Trial Court till conclusion of the investigation. and the concerned Police Station shall verify the present and current address of the petitioner.
