====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 11-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Mashrak P.S. Case No. 300 of 2018, instituted for the offence under Sections 413 and 414 of the Indian Penal Code.

It is alleged in the written report that petitioner has been arrested with Motorcycle. The Police searched house of the petitioner and recovered two Motorcycles but no paper of the Motorcycles in question has been produced. Counsel for the petitioner submits that two Motorcycles have been recovered from joint house of the petitioner. He has no concern with aforesaid Motorcycles. The Motorcycle which has been recovered from his possession was not stolen Motorcycle. There was no case lodged for the

Patna High Court Cr.Misc. No.74190 of 2018(3) dt.11-01-2019 2/2 aforesaid Motorcycle of having been stolen one. Petitioner is in custody since 23.8.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran (Chapra) in connection with Mashrak P.S.
