Petitioners, who are in custody, seek bail in connection with Kotwali P.S. Case No. 485 of 2018 registered for the offence punishable under Sections 417, 418, 419, 420, 468, 120(B) of the Indian Penal Code and Sections 66(B), 66(D) of the I.T. Act.

Informant who is the Officer on Special duty, Bihar State Power Holding Company Ltd., Patna has given a written complaint that some anti social elements are approaching the successful candidates and demanding amount as bribery for getting them finally selected and such demand was reported to the authority by the successful candidates. Petitioners have been implicated in this case on the basis of confessional statement made by co-accused. Mobile number of petitioner is not

Patna High Court Cr.Misc. No.72690 of 2018(2) dt.11-12-2018 2/2 included in mobile numbers used for committing unlawful act. No money transaction has been made and only on basis of suspicion they have been apprehended in this case. Petitioners have no criminal antecedent and they are in custody since 16.08.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Kotwali P.S. Case No. 485 of 2018 subject to the conditions that:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and their absence on two consecutive dates without proper and sufficient reason the trial court will be at liberty to cancel their bail bond.

(3) If the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
