JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-01-2019 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Bhargama Police Station Case No. 162 of 2018, disclosing offences under Sections 341, 323, 324, 307, 354B, 379, 447, 504, 506/34 of the Indian Penal Code. Learned Counsel for the petitioners has submitted that the informant and these petitioners come from the same family and the petitioner no. 1 is the nephew of the informant. He submits that injuries have been found to be simple in nature and narration of the prosecution, in the First Information Report, is exaggerated version of what had actually been happened. It is

Patna High Court Cr.Misc. No.76810 of 2018(2) dt.11-01-2019 2/2 alleged against petitioner no. 1 that he assaulted with fists and slaps; whereas against other petitioners, who are ladies, the allegation is general and omnibus.

Considering the above submissions, this application is allowed.

Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Bhargama Police Station Case No. 162 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
