====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-01-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Ghorasahan P.S. Case No.242 of 2018 registered under Sections 419 and 420/34 of the Indian Penal Code besides Section 7 of the E.C. Act and Section 63 of the Copy Right Act, 1956. The accusation is that on receiving the information about seizing of the duplicate fertilizers by the Ghorasahan Police, the informant being the Fertilizer Inspector-cum- Block Agricultural Officer, Dhaka, reached at Ghorasahan Police Station and he came to know that seven bags of duplicate D.A.P. fertilizer and five bags of duplicate Paras D.A.P. fertilizer were

Fertilizer and 24 bags of Paras D.A.P. fertilizer were recovered from the shop of Chandan Kumar. Learned counsel appearing on behalf of the petitioner submits that, in fact, about seizing of the aforesaid bags of duplicate fertilizer from the shop of the petitioner, the police has not taken the signature of the petitioner or his family members on the seizure list. The petitioner has no criminal antecedent and is in custody since 30.08.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, in connection with Ghorasahan P.S. Case No.242 of 2018.
