JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks bail in connection with Kotwali (Tilkamanjhi) P.S. Case No. 527 of 2017 registered under Sections 395 and 397 of the Indian penal Code. Earlier prayer of bail of the petitioner was rejected vide order dated 29.10.2018 passed inn Cr. Misc. No. 64427 of 2018 with observation to renew prayer of bail after framing of charge. Submission of learned counsel for the petitioner is that earlier charge has already been framed at that point of time on 13.07.2018 but due to mistake, he could not point out the same. Now, he has remained in custody for more than ten months and is ready to abide by any terms and conditions imposed upon him.

No.75387 of 2018(2) dt.20-12-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional District and Sessions Judge, Bhagalpur in connection with S.T.No. 476 of 2018 arising out of Kotwali (Tilkamanjhi) P.S. Case No. 527 of 2017 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned. The petitioner shall co-operate in disposal of trial and make himself available as and when required by the court and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.
